Winning the tender before you submit it

Public procurement in Kenya rewards the supplier who makes the buyer's job easy. A plain-spoken guide to getting your paperwork ready.

A tender evaluator may read dozens of bids in a week. The ones that stand out are rarely the loudest. They are the ones where every requirement has an obvious answer on an obvious page.

Know the ground rules

Kenya's public procurement runs under the Public Procurement and Asset Disposal Act, 2015. Tender notices are published on the government's Public Procurement Information Portal, and many entities repeat them on their own websites.1 Always read the tender document itself, because rules and mandatory documents vary by entity.

What AGPO is, and is not

Under the Access to Government Procurement Opportunities programme, procuring entities must set aside at least 30 percent of their procurement spend for enterprises owned by youth, women and persons with disabilities. To qualify, an enterprise must have at least 70 percent membership of the target group and 100 percent leadership from it.2 The set-aside is real money: businesses in these groups won state tenders worth Sh28.6 billion in the year to June 2024, up 10.8 percent on the year before.3

Make the evaluator's job easy

Use the checklist below to rehearse a response. It is generic, so adapt it to each tender.
